"Registration" for gardeners: how implement the decision of the Constitutional Court

The author analyzes the ways of improving the Federal Law of April 15, 1998 № 66-FZ «On gardening, gardening and dacha non-profit associations of citizens» in connection with the need to implement the decisions of the Constitutional Court of the Russian Federation on April 14, 2008 № 7-P and on June 30, 2011 № 13-n. Examines the concept of «holiday home», «garden house», «residential building», «house» and an appropriate legislative framework. Concludes that the implementation of the provisions of the Act creates serious problems in the definition of the legal nature of such phenomena as the country economy, and suggests ways to address this problem.
