Особенности рассмотрения финансовых споров в международном коммерческом арбитраже

Предметом настоящей статьи является арбитражное рассмотрение споров, возникающих в связи с финансированием и финансовыми продуктами, как правило, в международном (транснациональном) контексте. Исследование основано на анализе развития финансовых рынков Китая и стран Западной Европы. Изучение данной темы позволило сделать вывод, что, во-первых, некоторые финансовые споры имеют характеристики, отличные от других коммерческих споров, во-вторых, международный коммерческий арбитраж все шире и чаще используют для разрешения финансовых споров.
