Validity of using term «Sufficient basis» in criminal procedure

Purpose: Studying of terminology used in Russion legislaton in support of their procedural decisions. Methodology: Was used a comparative-legal, historical-legal and formal-legal methods. Results: During the article, we analyzed using of the concepts of «sufficient evidence», «reasonable grounds» and «sufficient data» in a criminal trial, gave their characteristics. Established that concepts have a number of similarities and differences, and the legislator often do not share their understanding. At the same time the usefulness of the concept «reasonable grounds» is questionable, since it emphasizes the causal link, the reason for the decision, but not its content side. The concept of «sufficient data» reveals the need to inform decision-making process, and therefore more consistent with the goals and objectives of the criminal proceeding. Novelty/originality/value: This article contains proposals aimed to improve the existing legislation, as well as provides the author’s formulation of the terms «data» and «grounds».
