Purpose: Research of foreign experience of creation of judicial system and legal proceedings on arbitration and civil cases. Methodology: Historical and legal and formally legal methods were used. Results: The important principle of activity of judicial bodies recorded in rules of international law is the maximum availability of courts to citizens, that is elimination whenever possible of any obstacles for the appeal to courts of simple people. The principle of availability of civil and arbitration courts to citizens can be found in the Constitution of the Russian Federation at best only in an implicit, implied look though it is vital in order that citizens began to treat with respect courts and judges. Novelty/originality/value: Article has the high scientific value as contains scientifically based conclusions, significant for development of domestic system of implementation of justice.
