Accrual of labour relations in various forms of contract and agency labour

The article considers legal aspects of accrual of labour relations in various forms of contract and agency labour (outsourcing, outstaffing, staff leasing). The author says that legal construction of extra work is very difficult, there are two kinds of right-relations: the relations between personnel agency and the service-addressee (customer) and right-relations between personnel agency and the worker. The legal employer in these relations is the personnel agency, because it concludes the labour contract with the worker, and the enterprise (the service-addressee) is the actual employer, the worker works on territory of the enterprise (the service-addressee), submits to the rales of internal labour schedule and performs the labour function for this enterprise.
