Production of a preliminary investigation by the investigation group: on the question of the positive aspects of the group investigation method

The content of the article analyzes the issue of modern legal regulation of the collegial nature of the preliminary investigation. The author presents various doctrinal approaches to understanding the group, collective process of investigating crimes, analyzes the opinions of scientists on the effectiveness and efficiency of this process for criminal proceedings. At the same time, the author considers the main positive aspects of the collective method of investigation, expressed in certain advantages in comparison with the process of the sole investigation of crimes. In addition, the issue of organizing investigative-operational groups in criminal proceedings, the procedure for creating and normative regulation of these groups is considered. Also in the content of the article, provisions were considered on the institution of procedural control and prosecutorial supervision over the activities of investigative (and investigative-operational groups) in criminal proceedings, due to the fact that these provisions are a distinctive feature of control and supervision of the process of group activities of participants investigative (and investigative-operational groups). The author, based on the study of the above positions of various authors and investigative practice related to the assignment of a preliminary investigation to investigative groups, comes to the conclusion that the investigation of crimes by investigative (or investigative-operational) groups is characterized by high efficiency and effectiveness.
