Problems of fighting cybercrime in Russia

Introduction. We live in the era of global digitalization and the formation of new legal relations, which are influenced by information technology and intellectual mind. A powerful impetus to the development of all digital relationships in society was given by two pandemic years, when self-isolation of the entire population quickly redirected people to work in the new conditions of a remote format. At the same time, crime intensified and has transformed into new types and forms, using information technologies for profit. New types of cybercrime have emerged that require immediate response from the state and law enforcement agencies. The study of cybercrime and the development of scientifically based countermeasures require scientific research in this area. The objective is to analyze cybercrime as a new criminal phenomenon, update the terminology of crimes connected with the use of cyber technologies, and develop proposals for combating cybercrime in Russia. Materials and Methods. Achieving this goal was provided by the use of general scientific and special legal research methods: comparative analysis, with the help of which the relevance and problems of modern cybercrime problems were identified based on materials from foreign and Russian researchers; scientific analysis, with the help of which new legal concepts are substantiated; synthesis, which made it possible to clarify the concepts of cyber criminality and a cybercrime; formal legal, which made it possible to analyze the criminal legislation of Russia; systematization, thanks to which it became possible to formulate the most important conclusions and proposals for combating cybercrime. Results and Discussion. Foreign researchers have included cybercrime as one of the global risks threatening the world community. The digital transformation of all spheres of our society requires the development of comprehensive measures to combat cybercrime in Russia. Computer crimes provided for in the Criminal Code of the Russian Federation do not meet the trends in the development of cyber technologies and have a narrow focus on protecting public relations associated with the use of computer and information technologies. In this regard, it is necessary to supplement the criminal law with modern terminology and consolidate the concept of cybercrime. Conclusions. As a result of the study, the key problems of modern cybercrime in Russia were identified. The question is raised concerning the need to develop comprehensive legislative regulation to combat cybercrime; the author's definitions of the concepts of cyber criminality and a cybercrime are proposed; proposals have been made to amend the Criminal Code of the Russian Federation.
