The vicarious liability of the municipalities and of the state in case of bankruptcy of the unitary enterprises

The article analyzes the Russian judicial practice in cases involving municipalities and the state to subsidiary liability in the bankruptcy of unitary enterprises and the practice of the European Court of Human Rights. The author comes to the conclusion that Russian judicial practice follows the path of attracting the owner to subsidiary liability if there is a causal link between the actions of the property owner and the bankruptcy of a legal entity, and the European Court more often draws attention to the institutional dependence of the unitary enterprise on the public owner.
