Challenging transactions with preference in bankruptcy procedures

The article is devoted to the analysis of the elements of the void transaction aimed at the preferential satisfaction of claims of certain creditors to the others in bankruptcy procedures. Emphasis is placed on the subjective factors that directly affect the correct qualifications of deals with preference, namely the creditor's awareness that the transaction can result in his/her advantages over other creditors. The author considers various approaches of jurisprudence and makes a conclusion aimed at the effectiveness of law enforcement.
