The body of inquiry is a structural unit of the executive authority

The article examines the problems that are inherent in a broad (organizational and managerial) approach to understanding the body of inquiry as a subject of criminal procedural relations. The body of inquiry is considered as part of the state apparatus, that is, a team of officials, which is headed by a chief and ensures the exercise of the powers provided for in Part 2 of Art. 40 Code of Criminal Procedure of the Russian Federation. It is noted that under the bodies of inquiry it is necessary to understand the structural units that are part of the multifunctional bodies (institutions) of the executive power and have the potential to carry out criminal proceedings. They must have a staff of employees who are suitable for participation in criminal procedural legal relations as an inquirer, including the implementation of inquiries, the consideration and resolution of reports of crimes, the production of urgent investigative actions and the execution of instructions from the investigator or other interrogating officer.
