Mediation and effectiveness of the institute of bankruptcy

The article provides an overview of mediation, it is analyzed Unlike traditional methods of conflict resolution necessity to use constructive potential of mediation in resolving disputes. Particular attention is paid to analyzing the role of mediation in the process of bankruptcy of enterprises and organizations, disclosed the possible fields of application of mediation to improve the efficiency of bankruptcy institution in Russia. For the development of this direction the authors recommended improving the training system of arbitration managers by increasing their competence a mediation, as well as the introduction and consolidation at the normative level of mandatory pre-trial mediation procedure for resolving economic disputes between the debtor and creditors.
