The article presents the notion of signs, differentiating criminal responsibility, defines criteria and rules of selection of circumstances for their retention in the criminal law as privilegiruyuschih and qualifying signs. The author notes that the discrepancy of the circumstances one of the main criteria for the selection testifies to the impossibility of its legal regulation.
