Mechanism for the initial investigation of violations of environmental regulations in the performance of work

Purpose: The authors of the article note the need to improve the activities of law enforcement agencies to identify and investigate violations of environmental protection rules in the course of work, which is important both for theoretical study and for practical use. Methodology: The conclusions of the article are based on the use of the general dialectical method of cognition, as well as general scientific and special research methods. Results: The authors come to the conclusion that the content of the initial stage of the investigation of crimes under Article 246 of the Criminal Code of the Russian Federation should be based on whether the crime was reported by a specific person or organization, or the materials on the discovery of a violation of environmental protection rules during the work were received from environmental control bodies. The hypothesis is put forward that the optimization of the activities of investigators to identify and investigate violations of environmental protection rules in the course of work can be achieved by taking into account the features identified and indicated in the article for checking reports of such facts, as well as the specifics of the production of individual investigative actions. Novelty/originality/value: The article considers the differences in the procedure of actions of investigators when receiving information about the commission of crimes related to violations of environmental protection rules during the production of works from two different types of sources. It is indicated on the peculiarities of the production of investigative actions in the course of the investigation of crimes of the category under consideration.
