The goal of the article is to conduct a comparative analysis of the domestic criminal procedure law and its analogue in the Republic of Azerbaijan - a state where in some cases there is no stage of initiating a criminal case, in which, simultaneously with the criminal process, the activities of specially authorized officials, related with criminal prosecution. Studying and comparing the procedural norms in force on the territory of the Russian Federation and the Republic of Azerbaijan, the authors tend to establish how do the foreign institutions of criminal prosecution differ from the domestic one, whether they have similarities, what are the differences between them and which form of implementation of this procedural institution is most optimal for modern criminal procedure law.
