On the issue of protecting the image of a citizen

In 2006, Article 152.1, devoted to the protection of the image of a citizen was introduced into the Civil Code of the Russian Federation. This rule alone does not seem to be sufficient to fully and effectively address the problems associated with the use and protection of the image of a citizen. Active use of social networks facilitates the dissemination of photos containing the image of a citizen, including without his consent, as well as containing a modified image of the citizen, which may affect his honor, dignity, or violate his business reputation. Modern technology makes it easy to change the image of a citizen in photographs or videos, for example, by imposing a digital mask, the concept of which is not in Russian legislation. There is also no clear legal regulation of relations in which another person uses the image of a citizen, including for profit. Purpose: to conduct a comprehensive study of the problems of legal protection of the image of a citizen and the identification of problems of legal regulation of its use, the development of proposals for improving the legislation on the protection of the image of a citizen. Methods: dialectical method of cognition, comparative-legal, formal-legal, system-analytical, logical. Results: the author gives her definition of the digital mask and makes proposals for the protection of the image of a citizen when placing material on the Internet.
