To a question of need of preservation of arrest among types of the criminal sanctions established in the Russian Federation

Purpose: A research of a question of need of preservation of arrest among types of the criminal sanctions established in the Russian Federation. Methodology: Historical and legal, formal legal methods, and also a method of legal forecasting were used. Results: In article, in connection with the bill discussed in the sphere of lawmaking positive and negative sides of preservation in the Russian legislation of arrest as type of criminal sanction are analyzed. The conclusion is drawn that preservation in the existing Criminal Code of the Russian Federation of punishment in the form of arrest is inexpedient. Novelty/originality/value: Article has scientific value, being the complex analysis of organizational and legal aspects of preservation in the Russian legislation of arrest as type of criminal sanction.
