On the question of the personality of the criminal as a central element of criminalistic characteristics of crimes against life and health, performed by migrants to Russia from CIS countries

Based on the analysis of scientific literature, materials of law enforcement practice and official statistical data reflecting the dynamics of crimes committed by foreign citizens on the territory of the Russian Federation and the Irkutsk region, the presented article analyzes the forensically significant personality traits of migrant criminals who arrived in Russia from the CIS countries as a central element of the forensic characterization of crimes against life and health, ethnic characteristics and elements of the socio-psychological portrait of such migrants, their influence on the nature of illegal actions are determined. The crime of migrants who arrived in Russia from the CIS countries is determined by the “transparency of borders”, socio-political processes within the states - the former republics of the USSR, ethnic stratification of the population, interethnic conflicts, which, together with the frequent social disorder and mental depression of migrants in Russia, give rise to antisocial behavior . A serious influence on the commission of crimes against life and health by such migrants is exerted by their close contact with compatriots, “blood ties”, “fellowship”, narrowly selfish interests, negative social orientation, aggressive attitude towards representatives of other nationalities, and some national characteristics of temperament and traditions in a direct way. determine the content of the method of committing crimes against the life and health of citizens. The forensic characteristic, being part of the forensic methodology for investigating the crimes under study, determines the direction of disclosure and investigation, the construction of versions, and consists of a set of elements that are in a correlation. In the practice of investigating crimes, its use allows narrowing the search for possible suspects.
