The study of the legal nature of a civil claim in criminal proceedings allows us to identify the features of the content and the set of problems of improving normative regulation of this legal institution. This regulation concerns the issues of excluding double damages, the expediency of bringing a regressive action in a criminal case, the clarification of the limits of legal regulation of the legal institution in relation to the issues of ensuring actions for damages caused by a person subjected to criminal prosecution, in the event of termination of a criminal case on non-rehabilitative grounds.
