Contract of concessions rights of subsoil using as the legal basis of placement property under the ground

The article deals with the legal aspects of civil engineering, in particular the legal basis of placement of capital construction underground. Analyzes currently used contractual design and makes conclusion about its inconsistency with the expediency requirements. Considers and justifies the possibility to assign the right of subsoil use for the construction of underground structures. Suggests that a new kind of civil contract, which will allow the person conducting the underground construction, to acquire the necessary and sufficient rights to use the land / subsoil and as such optimize costs and eliminate the risk of litigation.
