The article discusses the features of legal regulation and the practical application of the guarantee institution, which was used in the Soviet period mainly in foreign trade transactions, and a bank guarantee as a new security method enshrined in the Civil Code of the Russian Federation. The paper also characterizes the main international sources related to this security method. The author compares the bank guarantee with non-processor methods of ensuring the fulfillment of obligations, and also explores the most complex issues that arise in modern civil circulation in the practice of applying a bank guarantee. A lot of attention in the article is paid to the analysis of legal positions formulated regarding the application of a bank guarantee by the highest judicial bodies of Russia.
