Current problems of the contract system in the field of public procurement (based on the example of transport)

The article analyzes current problems of the contract system in the field of public procurement using the example of the transport industry, and reveals the importance of public procurement for the national economy. The procurement activities of transport enterprises are regulated by two Federal laws: - April 5, 2013 No. 44-FZ “On the contract system in the field of procurement of goods, works, services to meet state and municipal needs”; - July 18, 2011 No. 223-FZ “On the procurement of goods, works, services by certain types of legal entities.” In order to obtain applied analysis results, current problems of the contract system in the field of public procurement were classified into problems of procurement organizers and procurement participants. Current problems of procurement organizers: limitation of the volume of purchases from a single supplier, imperfection of mechanisms for determining the initial maximum price of contracts (IMCP). Current problems of procurement participants: the impossibility of collective participation in public procurement, the need to comply with procurement standards from SMEs, the need to withdraw working capital to provide security for contracts. Despite the fact that procurement legislation is constantly changing, taking into account, among other things, industry-specific features, it seems advisable to consider the possibility of special regulation of procurement in the transport industry.
