Victimological public dangerous problems of commercial surrogacy in Russia

The question is raised about the need to study and ensure the victimological safety of commercial surrogacy. The problem of victimological safety of the human embryo and fetus is analyzed in criminological and victimological aspects. The problems of victimization of children born with the help of commercial surrogacy are investigated. Investigation into the circumstances of the sale of infants born to surrogate mothers to foreign citizens established numerous violations of the legislation of the Russian Federation by private clinics that entered into agreements with single men of non-traditional sexual orientation, including those who were not biological parents of the acquired children. Proofs of the victimization of the provision of surrogacy services to persons of non-traditional sexual orientation are presented on the basis of materials from foreign judicial practice. It is noted that the lack of state control over the circulation of embryos and genetic material, and in general over this assisted reproductive technology; treating a child as a thing that can be purchased or abandoned if it does not suit the customer with its parameters, contributes to the victimization of children born on the basis of a commercial surrogacy contract. An analysis of the international scientific discussion of this problem also confirms the existence of a high risk for such children to become a victim of sexual exploitation and trafficking, including for the purpose of transplantation. Concrete proposals are being made to ensure the victimological safety of children.
