Subjective side of crime stipulated in article 208 of the Russian Federation Criminal code

The article deals with the peculiarities of a subjective side of crime stipulated in Article 208 of the RF Criminal Code. The author comes to the conclusion that the nature of the paramilitary leader intent, the paramilitary organizer intent, the paramilitary member intent and the intent of a person, who finances illegal armed forces differ. It is justified that Article 208 must include the reference to the goals of the persons as the aim to obtain or to maintain capacity to conduct military actions. If the goals are enshrined in law the crime stipulated in Article 208 of the RF Criminal Code could be separated from other crimes, organized crime in particular (Article 209 of the RF Criminal Code).
