The role of probation officer in criminal proceedings of the Republic of Kazakhstan in the implementation of pre-trial probation

Introduction: the article analyzes the role of probation officer in a criminal process, whose main task is to provide a court with a pre-trial report on the suspect (accused) in pre-trial probation. Materials and Methods: the methodological basis for the article is general scientific methods of analysis of the considered aspect (observation, comparison, description, etc.), the legislation of the Republic of Kazakhstan, as well as normative legal acts of a number of the Commonwealth of Independent States member states. Results: analyzing the experience of some foreign countries, including members of the Commonwealth of Independent States, shortcomings in the national probation activities in pre-trial probation which include the ambiguous status of probation officers in the criminal process are identified. Discussion and Conclusions: the author states that it is necessary to consolidate the legal status in criminal procedural law of the Republic of Kazakhstan the legal status of probation officer as the other persons participating in criminal proceedings.
