Innovation in the formation of the arbitration tribunal: can a robot replace a human arbitrator?

Purpose: The study of the application of artificial intelligence in the formation of the arbitration tribunal and the possibility of replacing the human arbitrator by a machine-arbitrator (robot). Methodology: Methods of analysis and synthesis, as well as comparative legal method were used. Results: The article provides definitions of artificial intelligence and artificial general intelligence; considers the possibility of using artificial intelligence in the formation of the arbitration tribunal, analyzing its advantages and disadvantages; analyzes the legislative acts of Switzerland and Russia and the rules of arbitration institutions on the possibility of replacing an arbitrator by a machine-arbitrator (robot). It is established that a machine-arbitrator (robot) cannot replace a human arbitrator because It does not have some human characteristics, such as emotions, empathy, the ability to explain Its decisions, the ability to understand witnesses and experts who are very important in the implementation of the functions of the arbitrator. Novelty/originality/value: The article has a high scientific value as it is one of the first attempts to analyze the possibility of replacing a human-arbitrator with a machine-arbitrator.
